Terms & Conditions - 2023
The following terms and conditions apply to any course delivered by PassRite Driving Academy Limited and its website www.passrite.co.nz
Acceptance of Terms and Conditions:
As a user, course registrant (paid, direct credit or on account) or submitter of online forms on the PassRite Driving Academy website (www.passrite.co.nz) , or engaging PassRite Driving Academy to deliver services, you accept these terms.
These terms and Conditions have the following expressions and meanings:
'Service', 'Services' means any service that is provided by PassRite Driving Academy Ltd including but not limited to training courses;
'We' and 'Us' and 'Our' means PassRite Driving Academy Ltd;
'You' and 'Your' means a Customer;
Website' means the PassRite Driving Academy Ltd website at URL www.passrite.co.nz;
'Customer', ‘Customers’ includes any person registering for a service from PassRite Driving Academy Ltd.
Changes to Terms and Conditions
These terms and conditions may be changed from time to time. All changes will be effective immediately upon posting changes on the PassRite Driving Academy website.
It is the responsibility of all PassRite Driving Academy customers to be familiar with the latest terms and conditions.
Your on-going use of the PassRite Driving Academy website represents your agreement to these terms and conditions.
Insurance and Indemnity
The client is responsible for all insurance related risks in respect of all vehicles, equipment and loads provided by them for use by their drivers/ operators and our instructors in the conduct of any training
Except where we have expressly accepted responsibility to you under these terms, you will keep us protected against any legal action taken against us and pay us any costs, losses, or expense we incur in connection with your use of our website or any failure by you to comply with these terms.
Service Guarantees
PassRite Driving Academy’ provision of services are covered under the Consumer Guarantees Act.
PassRite Driving Academy provides fit for purpose training services with reasonable care and responsibility and skill.
Your rights for service provisions and supply of service are covered under legislation. More information can be provided by the Office of the Privacy Commissioner.
Your information
As a user of the PassRite Driving Academy website you warrant that you have provided complete, accurate and current personal or business information.
PassRite Driving Academy may phone or email you to verify these details.
Without limiting any other rights or remedies we may have, you agree not to permit any other person to use your details or customer information for the purchase of services through the PassRite Driving Academy website
Course/Training Schedule
The availability of courses and dates published on the Website are subject to change without notice.
Courses are updated as information comes to hand including availability of space.
While every effort is made to ensure that errors are omitted, these may arise from time to time. If information on the website is incorrect, registrants will be contacted and alternative options discussed.
We reserve the right to cancel or alter the dates of any ‘open’ courses due to insufficient numbers of students.
We reserve the right to suspend training where to continue would breach the Health and Safety at Work Act 2015 (“HSWA”), or where continuing might place students at an unacceptable level of risk.
We reserve the right to refuse to train any person who is deemed by us to be unfit due to health reasons including but not limited to intoxication or behavioural issues.
We reserve the right to refuse to train any company, employee or individual who we reasonably believe may be in competition with us. Course duration may vary based on number of Students attending and level of knowledge and / or experience.
NZQA Credit Registration
As an NZQA accredited Private Training Establishment (PTE), PassRite Driving Academy register NZQA credits on behalf of the student. NZQA credit registration is compulsory.
NZQA credits are based on the credits available on a specified unit standard as part of a course.
These credits are added to your record of learning held by NZQA. These are your credits and support your evidence of completion of unit standards and qualifications.
There is a cost to deliver the course, register the credits and administer the registration of credits.
Direct costs from NZQA are passed on through the specified credit cost.
These costs are included in the advertised course cost. Credits are uploaded onto NZQA framework within 90 days of course completion.
Where additional costs exist, these are mentioned on the course detail page – (EG. NZTA licence fees and costs associated with medical certifications)
Offsite Attendee Numbers
Where you are making a booking for training on your own site, a minimum number of attendees is required (5 attendees). If the number changes:
1. Additional fees will be charged for any increase in the number of attendees in accordance with the registration costs (advertised and agreed)
2. A reduction of numbers of attendees is subject to our cancellation policy or minimum number requirements.
Online Payments
We accept payment for purchases made through the PassRite Driving Academy website via Visa and Master Card credit cards only.
A payment surcharge (non-refundable) will apply at the time of payment.
All charges are made in New Zealand dollars and include GST.
We charge your credit card at the time of your purchase via the DPS secure payment system This is a secure payment gateway through DPS and security certificate verified for your protection.
Receipts for online payments will be emailed to the respective email (provided upon booking) once we have received the funds in our bank account. This can take up to 7 working days to process.
Payment Terms
'ON ACCOUNT' – The Customer agrees to make full payment for Services on 20th of the month following the date of the course unless you have agreed approved payment terms with PassRite Driving Academy Ltd.
‘On Pre-payment’- The Customer agrees to make full payment for services at the time of booking.
PassRite Driving Academy reserves the right to charge the customer interest of 5% per month on all overdue amounts at PassRite’s discretion.
The Customer agrees to pay PassRite Driving Academy all agency collection fees associated with the collection of an unpaid debt.
‘STOP CREDIT’ – PassRite reserves the right to place a customer/company on stop credit upon failure to meet PassRite’s “On Account” payment terms.
If your account has been placed on stop credit, the customer agrees to make full payment for services at the time of booking.
Any future bookings made prior to the commencement of the “stop credit” will need to be paid upfront and/or may be cancelled.
‘INDIVIDUALS’ – The Customer agrees to make full payment prior to attending the course.
The booking/space is not secured until full payment has been received by PassRite Driving Academy Ltd.
The Customer agrees to pay PassRite Driving Academy all agency collection fees associated with the collection of an unpaid debt.
Prices and Additional Fees the prices published on the Website are subject to change without notice unless you have an agreement with us stating otherwise.
The Customer agrees to pay any additional costs incurred by PassRite Driving Academy Ltd, such as travel and accommodation when local resource is unavailable.
These charges will be charged at cost to the Customer and will be advised during the booking process.
Cancellation or rescheduling of training courses and/or booked services may be made over the phone with Admin Team but must be confirmed in writing to either sales@passrite.co.nz or PassRite POC you have been dealing with.
Cancellation and Withdrawals/Refund policy
Refund and Cancellation Policy fees are based on full course costs and will be incurred on the following basis:
· Where you have given notification to PassRite Driving Academy Ltd at least 7 working days’ prior to scheduled training or booking, there is no cancellation fee / 100% refund if pre-paid.
· Where you have given notification to PassRite Driving Academy Ltd within 3-6 working days’ prior to scheduled training or booking, there is a 50% cancellation fee / 50% refund if pre-paid.
· Where you have given notification to PassRite Driving Academy Ltd less than 2 working days’ prior to scheduled training or booking, there is a 100% cancellation fee / NO REFUND if pre-paid.
· Administration and processing fees may apply.
· We are happy to substitute course attendees provided they meet course criteria
Refunds may take up to, but not limited to, 10 working days to process, and is on a case-by-case basis.
Refunds may also be processed over multiple dates, depending on the value of the refund and how the fees were originally paid (online via Visa/Master Card, Cash, Eftpos, Direct Credit/Internet Banking etc.) PassRite will inform you about your refund status and provide any relevant information prior to commencing the payment/s.
Time Line to complete course: All courses started must be completed in full within 18 months of course commencement date otherwise extra re- training costs may be applied
Rescheduling Policy fees are based on full course costs and will be incurred on the following basis:
· Where you have given notification to PassRite Driving Academy Ltd at least 7 working days’ prior to scheduled training or booking, there is no reschedule fee.
· Where you have given notification to PassRite Driving Academy Ltd within 3-6 working days’ prior to scheduled training or booking, there is a 10% reschedule fee.
· Where you have given notification to PassRite Driving Academy Ltd less than 2 working days’ prior to scheduled training or booking, there is a 20% reschedule fee.
· Where you have given notification to PassRite Driving Academy Ltd less than 1 working days’ prior to scheduled training or booking, there is a 100% reschedule fee.
Drive Cancellation/Rescheduling
· Where you have given notification to PassRite Driving Academy Ltd less than 24 hours prior to scheduled drive, a standard cancellation / rescheduling fee of $195.00 plus GST applies per cancelled drive.
Failure to attend training Failure to attend a course will result in a ’No Show’ attendance status. All ‘No Shows’ will be charged 100% cancellation/reschedule fee.
Student Withdrawal Where a student decides to withdraw from one of PassRite Driving Academy Ltd courses after course commencement, an individual may receive up to a 50% refund. If a student has been booked by their Employer, the Employer will get invoiced at least 50% of course fee or receive up to a 50% refund if pre-paid.
PassRite Driving Academy Ltd will not be liable for any costs incurred by the Customer due to cancellation arising from circumstances beyond our control including but not limited to Trainer illness.
PassRite Driving Academy Ltd reserves the right to cancel any public course if the course has not reached its minimum number.
Group Booking Discounts
If the Customer has made a booking for a specific course where a group discount applies, the discount shall only apply if specified number of employees have attended.
If minimum number for group discount has not been reached, the standard list price will be charged per employee.
PassRite Driving Academy Ltd Withdrawal
is defined by NZQA as voluntary or regulatory closure, insolvency, ceasing to offer an enrolled course, or withdrawal or accreditation or course approval by NZQA.
As such, these events are outside of your control. If you are enrolled in a course, you will receive 80% refund if pre-paid.
Late Student Arrival
Within 20 minutes of scheduled start time: Student may remain on course only at the trainer’s discretion.
Over 20 minutes of scheduled start time: Student may not attend the course.
Should it be necessary for the student to return to complete the course at a later date due to late arrival issues PassRite Driving Academy Ltd reserves the right to pass on any associated costs to the student or the employer of the student.
Company Specific Courses
If training is held at the Customer’s premises, the Customer agrees to provide all facilities including; training room, air-conditioning / heating, bathroom access, power outlets, tables, chairs, whiteboard, projector screen/white wall, and tea/coffee facilities.
Facilities for specific courses are as specified in the confirmation email and are according to the course requirements. The Customer also agrees to pay minimum daily rate for the specific course regardless of how many employees attend. Minimum daily rates are subject to course type and length.
Safety Gear and Personal Protective Equipment (“PPE”)
In accordance with the HSWA, all students are required to comply with any instruction, policy or procedure issued by PassRite Driving Academy Ltd in relation to the use of PPE.
This includes, but is not limited to, the wearing of hard hats and safety footwear.
Failure to comply may result in a student being removed from the course in the interest of safety.
Should it be necessary for the student to return to complete the course at a later date, PassRite Driving Academy reserves the right to pass on any associated costs to the student or their employer.
Special Requirements
Prior to course commencement, PassRite Driving Academy Ltd must be advised if the student has any special requirements including but not limited to health, literacy and cultural requirements.
Where a reader/writer is required, it is Customer’s responsibility to supply one. The reader/writer cannot be another student attending the same course or a family member.
Student Progress / Requirement for Completion
Learning objectives are detailed at the beginning of each training module and assessment is conducted throughout the course.
A practical assessment may also be conducted in some courses.
Students will be required to achieve the required level of competency in all areas of the assessment to be awarded the unit standard(s) and credits.
Assessment is conducted in compliance with competency based assessment according to NZQA criteria.
Course Pre-Requisites
the Customer accepts full responsibility for failure to abide by any course pre-requisites.
This includes, but is not limited to, completing and returning course paperwork, evidence of competency, attestation forms.
Failure to meet the pre-requisites most likely will result in additional fees. Pre-requisites are outline on our website, course information sheets and course confirmation letters.
Attestation Forms
Where an Attestation Form is required, the student will have a timeframe given from the date of the course to complete and return the form to PassRite Driving Academy Ltd.
Failure to return a completed Attestation Form before due date may prevent the unit standard being processed as competent.
If you receive funding or Grants for training
PassRite Driving Academy Ltd accepts no responsibility for the withdrawal of any funding or subsidies.
In the event that funding or subsidies are withdrawn, or the Customer is found not to be eligible for the funding or subsidy, PassRite Driving Academy Ltd will invoice the Customer the full course cost and the Customer remains liable for that amount.
Quality Assurance and Health and Safety
As part of our Quality Management System (QMS) we have processes in place to internally and externally moderate and evaluate all our training and assessments and have in place a formal Health and Safety Policy and Plan which all our instructors are required to adhere to.
This follows the Health and Safety at Work Act 20015.
New Zealand Privacy Act 2020
PassRite Driving Academy (we, us, our) complies with the New Zealand Privacy Act 2020 when dealing with personal information.
Personal information is information about an identifiable individual (a natural person) The individual student will have full access to their own course file, Our regulatory bodies ( EG. Waka Kotahi NZTA, NZQA) have access to your file under the provisions of the ACT to ensure consistency of training and standards.
